1. Acceptance of Terms
By accessing or using LinguaTrainer at linguatrainer.app ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
The Service is operated by Vasyl Rybalka, an individual based in Świnoujście, Poland ("we", "our", or "us").
2. Description of Service
LinguaTrainer is an online language learning platform that provides interactive Writing, Listening, and Speaking exercises for learning English, German, and Polish vocabulary and sentences. We offer a Free plan and paid Standard and Premium subscription plans. The features included in each plan are listed on our pricing page.
3. User Accounts
- You must be at least 16 years old to use this Service, or have the consent of a parent or legal guardian where required by the law of your country.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activities that occur under your account.
- You must provide accurate and complete information when creating your account.
- You may not use another person's account without permission.
4. Subscriptions, Payments and Billing
- Paid subscriptions are billed monthly in advance and renew automatically at the end of each billing period until cancelled.
- Our order process is conducted by our online reseller and Merchant of Record, Lemon Squeezy (lemonsqueezy.com). Lemon Squeezy handles payment processing, billing, invoicing, and applicable sales tax / VAT on our behalf. Your payment data is processed by Lemon Squeezy; we do not store your card details.
- Prices are listed in Euros (€). For consumers in the EU, displayed prices include applicable VAT, which is collected and remitted by Lemon Squeezy.
- You can cancel your subscription at any time from your Billing page. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then.
5. Refund Policy
- If you are not satisfied with your purchase, you may request a full refund of your most recent subscription payment within 14 days of the charge by contacting us at info@linguatrainer.app.
- Refunds are issued by Lemon Squeezy, our Merchant of Record, to your original payment method.
- EU right of withdrawal: if you are a consumer in the European Union, you have a statutory right to withdraw from a contract for digital services within 14 days. By starting to use the paid features of the Service immediately after purchase, you request immediate performance of the contract and acknowledge that you lose the right of withdrawal once the service has been fully performed; this does not affect the 14-day refund offered above.
- After the 14-day period, we do not offer refunds for partial or unused subscription periods, except where required by applicable law.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorised access to our systems.
- Interfere with or disrupt the Service.
- Share your account credentials with others.
- Use automated tools to access the Service without our permission.
7. Intellectual Property
All content, features, and functionality of LinguaTrainer — including but not limited to text, graphics, logos, and software — are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of data or progress. Nothing in these terms limits any statutory warranty rights you have as a consumer.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.
10. Termination
We reserve the right to suspend or terminate your account if you violate these Terms of Service. You may delete your account at any time by contacting us at info@linguatrainer.app.
11. Governing Law
These terms are governed by the laws of Poland. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes. Your continued use of the Service after changes constitutes acceptance of the new terms.
